THIS IS A LEGALLY BINDING RELEASE, WAIVER AND INDEMNIFICATION OF LIABILITY, AND EXPRESSES ASSUMPTION OF RISK. 

Whereas, I (the “Guest”) have been invited to IndianZ Stone Ranch, located at 3704 Martin Road, Jacksboro, Texas 76458, a working ranch, (the "Ranch”), and I intend to participate in activities in which I could be injured or which might result in death, including but not limited to: horseback riding, fishing, running, hiking, exploring, playing, biking, swimming, hunting, shooting guns, and riding recreational vehicles (collectively “Activities”). While at the Ranch, I may encounter various potential hazards, including but not limited to: wild animals, venomous snakes, disease carrying animals, firearms, barbed-wire or electrical fences, poisonous plants, poisonous insects, poisonous spiders, open bodies of water, creeks, cliffs, falling rocks, ditches, holes, sharp objects, blinds, tree stands, and other elements and conditions which could be considered dangerous. In consideration of being permitted to participate in the Activities of the Ranch, I fully and absolutely understand and assume full responsibility for the risk of injury, and do hereby forever absolutely release, even for their own negligence, and agree to hold harmless the Ranch, and I shall participate in the Activities and/or use any of the Ranch facilities, services, or equipment at my own risk. 

With this knowledge, I hereby accept full responsibility for any harm, injury or death which I or my family member(s) may suffer or experience while at the Ranch and I agree to conduct myself so as to prevent any harm, injury, or death from occurring to me or anyone else at the Ranch. I further do not expect or require that my family member(s) or I be warned or protected from any hazards connected or associated with my time at the Ranch and I fully recognize that there are unforeseeable dangers and risks to which I may be exposed by being a guest at the Ranch and I assume all of the risks and responsibilities in any way arising from or associated with the Activities. 

If any illness, injury, or accident occurs which, in the sole judgment of the Ranch’s staff or owners of the Ranch (the Ranch “Members”), requires immediate medical attention, I give consent for any Members of the Ranch to obtain such emergency treatment. I further consent to the signing of any releases by Members, which may be required by any medical care provider. I understand that in the event of an emergency medical situation I will be notified as soon as possible. I also agree to provide the Ranch with emergency contact numbers. 

I hereby represent that I have medical insurance and, if I am injured while at the Ranch, I will look solely to my insurance to pay any and all expenses arising from my injury. On behalf of my insurance carrier, I hereby waive all subrogation rights against the insurance carrier(s) of the Ranch, its owners, and any related entity, employee, agents, or other guests and their heirs, successors, and assigns from any claim, demand, cause of action, injuries, death and damages.

Further, I agree to release the Ranch and all of its affiliates, groups, and their respective governing boards, officers, directors, trustees, legal representatives, members, owners, employees, agents, administrators, assigns, contractors, their heirs, successors, and assigns and any related entity (collectively “Releases”), from any and all claims, to include breach of duty, demands, cause of action, injuries, death, damages which may arise from any visit or future visits to the Ranch, including claims of negligence, suits, judgments, damages, actions, and liabilities of every name and nature whatsoever, whenever occurring, whether known or unknown, contingent or fixed, at law or in equity, that may arise in connection with the summer program; including any injury, death, or damage to personal property (collectively “Liabilities”). I agree to defend, indemnify, and hold Releases harmless from and against any and all Liabilities. 

I have read this entire release. I fully understand that the terms herein are contractual and not a mere recital and that I have signed this Waiver voluntarily and of my own free act. I acknowledge that this Agreement is intended to be as broad and inclusive as permitted under the laws of the State of Texas from time to time in effect, and that if any portion of this Agreement is held to be void and unenforceable, the remainder shall, notwithstanding, continue in full force and legal effect.

I agree to all of the above on behalf of myself, my spouse, my children, our heirs, successors, and assigns.
